Position Description:
Investigate Workers Compensation recovery cases and aggressively seek recovery through negotiation, arbitration or litigation. Promptly and properly develop a theory of liability to provide accurate and timely recovery analysis and maximize recovery. Promptly conduct and/or direct investigation of all aspects of the recovery claim. Maintain an active and well documented diary as well as a favorable and productive file inventory. Adhere to all statutory and Unfair Claims Practice Acts. Communicate effectively both verbally and in writing with all external and internal customers. Proactively and aggressively control the use, work product and expenses of outside vendors. Efficiently utilize the Litigation Management Program to control the subrogation litigation inventory. Develop and maintain an outside panel/house counsel network and productive dialogue. Formulate litigation and recovery strategies with counsel and collaborate consistently throughout the subrogation process. Collaborate with the Recovery Claim Unit examiners where appropriate and help the identification of potential recovery opportunities. Maintain a reporting system to capture recovery dollars and expenses.
Required Competencies/Technical Skills:
3-5 years of claim handling experience preferred. Possess the ability to analyze recovery potential and recognize the legal elements needed to support a case. Possess the ability to conduct and direct investigative activities including the management of internal and external investigative sources. Possess the ability to recognize pivotal file developments and the decision making ability to act on the developments. Analyze the available resolution options on files and directly negotiate the cases to a settlement conclusion. Possess a strong understanding of the basic litigation process and basic legal concepts including burdens of proof, statute expirations and jurisdictional workers compensation statutes.
Candidates must have proven investigative skills with a proven ability to identify and gather relevant evidence. Possess the analytical and verbal skills both to formulate and execute a negotiation strategy. Candidate should possess a strong knowledge of liability theories and principles. Excellent oral and written communication skills as well as very good time and desk management skills. A good knowledge of industry trends, rules of evidence and legal regulations and requirements is essential. The candidate must demonstrate an ability to work in a collaborative fashion with a wide spectrum of people such as underwriters, producers and other internal and external customers. The aptitude to share and impart knowledge within a team environment is a strong benefit.
Education/Experience:
Prior experience in handling arbitrations and mediations to successful conclusion. Prior experience in analyzing leases, contracts and legal documents. Strong litigation management skills including expense control. Prior general liability experience a plus. College or University four year degree preferred or the equivalent work experience.
